In 2019 a group of neighbors from Burlington's South End and South Burlington's Queen City Park neighborhood came together in response to the announcement that Burton Snowboards was planning to host a new 1,500 seat HigherGround venue at their 266 Queen City Park Road location.
The Burton team had numerous meetings with neighbors, many alternatives to a 1500 seat concert venue were suggested. Burton proceeded with their application process.
Through the permitting process in Burlington and through Act 250 we have successfully had some minimal conditions placed on the project to help mitigate the impacts. However, the surrounding neighborhoods still need additional regulatory support and guarantees to ensure that we will be able to sleep at night and manage traffic concerns on our local streets during concerts which permitting allow 7 days per week, 365 days a year.

Why are neighbors concerned about this proposed venue?
In 2019, HigherGround’s owners stated that they planned on having between 100 and 120 events a year. Today we have a decision by the Act 250 Commission which allows events of up to 1,500 attendees, 365 day a year, running as late as 2:00am.
Why are neighbors concerned about noise?
As our noise expert testified before the Burlington DRB: "At the end of a concert, when more than a thousand people who have been drinking and have suffered a temporary threshold shift in their hearing ability, leave, they will not file out like monks …".
Background noise levels at night in the surrounding neighborhoods are in the low 30dBA (Quiet rural area). Modeled noise impacts could be in excess of 60 dBA (Someone practicing the piano or talking 3’ from your window.) at the nearest neighbor’s house.
Alex Crothers of HigherGround stated that "We're not concerned about noise," yet, HigherGround has been unwilling to make any guarantee to neighbors that there will not be noise disturbances late at night. Low frequency noise and vibrations from rock concerts at the current HigherGround location have impacted the neighbors near the current venue to the point that at least one family chose to move.
Why will traffic safety and parking be a problem?
The Burton property has a total of 426 parking spaces, this total includes parking for Burton corporate employees, in the modern world corporate employees do not stream out of work at 5:00pm. HigherGround calculated they need a minimum of 520 for a full 1500 person capacity show.
This parking estimate does not include band members, road, stage and sound crew members, security, bar and restaurant staff, ushers, ticketing and admin, Talent Skate Park or Burton employees working after doors open.
Access to the proposed venue is via two low capacity roads through residential neighborhoods. One of which travels over a one lane bridge, the other has an at grade railroad crossing.
Advisory Lanes
There are currently confusing painted “Advisory Lanes” on QCP Road. These are supposed to be adequate to safely indicate how pedestrians, bicyclists, and vehicles will commingle on QCP Road. There are no continuous dedicated bike lanes, sidewalks, or crosswalks on the street where the venue would be located. The final draft of the Queen City Park-Austin Drive Bicycle Pedestrian Connections Scoping Study by the CCRPC suggested that dedicated pedestrian infrastructure, either a sidewalk or shared path is considered, as well as marked/signed crosswalks. This additional infrastructure is years from implementation.
There have been three serious single car crashes on this bridge since November 2021
The first was a rollover crash, driven by a significantly intoxicated individual who was leaving a film screening at Burton. November 2021.
The second was also a highly intoxicated individual.

The third occurred during the first week of January 2023, There is no police report on this crash, but the photos show car parts as well as a chemical stain suggesting a severe impact.

The police report quotes the driver as leaving a premier of Dear Rider: The Jake Burton Story and admitted to drinking "right up until we left, if I'm being honest. Yeah, like you don't hit a guard rail...you know what I mean?"

In good faith, they spent months meeting with Burton / HigherGround trying to collaborate and work towards a project that the neighbors could endorse.
Before completing this process, Burton / HigherGround chose to move ahead and submit their permit application to the City of Burlington
It is deeply disappointing that to date Burton has chosen to push ahead with the permitting of Vermont’s largest rock venue and have displayed no willingness to provide verifiable assurances that the project will not negatively impact the neighbors.
